General Terms and Conditions

1. Agreement and Accounts

The agreement is formed when a customer creates an account, purchases credits, accepts these Terms, or otherwise uses the service. Customers must provide accurate account information, keep credentials secure, and remain responsible for activity under their account.

2. The Service

compassion.ink turns a single word or short phrase into generated visual artwork. Outputs may differ from customer expectations and may vary by language support, prompt interpretation, color rendering, and typography.

3. Credits, Billing, and Refunds

The service uses prepaid credits. Unless stated otherwise on the pricing page, one completed image generation consumes one credit, currently priced at $1 per image. There is no subscription. Unused prepaid credits remain available until used or refunded where required by law.

4. Acceptable Use

Customers may not use the service for unlawful content, deceptive impersonation, hateful or abusive misuse, rights-infringing material, security abuse, or attempts to disrupt the service or its providers.

5. Customer Responsibility for Outputs

Customers must review generated outputs before publishing or relying on them. The Provider does not guarantee that generated imagery will match the intended message, preserve exact colors across devices, or perform equally across all languages and scripts.

6. Subprocessors and Third-Party Services

The Provider relies on third-party subprocessors including OpenRouter, Google Cloud Platform, Firebase, Stripe, and Brevo. Service availability may be affected by these providers.

7. Liability and Consumer Rights

To the fullest extent permitted by law, the service is provided “as is.” Nothing in these Terms limits rights that cannot be waived under applicable consumer law. Special protections for consumers and withdrawal rights apply where required by Czech law.

To the maximum extent permitted by applicable law, the total aggregate liability of WriteIt.ai s.r.o. for any claim arising from or relating to these Terms or the Service shall not exceed the greater of: (a) the total fees you paid for the Service in the twelve months preceding the claim, or (b) €500. This cap does not apply to liability for gross negligence, wilful misconduct, death, or personal injury, nor to any liability that cannot be limited under mandatory law. AI-generated images may not always match expectations, and no warranty is given as to accuracy, language fidelity, or artistic quality.

8. Governing Law and Jurisdiction

These Terms and any non-contractual obligations arising from them are governed by the laws of the Czech Republic and directly applicable European Union law, including GDPR. Courts of the Czech Republic have jurisdiction unless mandatory law provides otherwise.
